His hearing is today and he will probably be confirmed.
His legal rulings led to lawlessness. His statement that some rules in the Geneva Conventions were "quaint" were used as the justification for torturing prisoners and shredding the reputation of the United States at Abu Ghraib.
And he will likely be confirmed because a) the Democrats don't have the votes; and b) despite having tangible evidence against this guy, there is still the widespread perception that he's not as totally loonie as Ashcroft.
Unofortunately, I suspect that he's MORE loonie than Ashcroft, and just better at hiding it.
